These General Terms of Use (GTU) govern the use of the COMPANIONCARE platform, accessible via the official website www.companioncare.fr and its mobile application. They define the terms and conditions for accessing, browsing, and using the platform and related services.
By using the COMPANIONCARE platform, you acknowledge that you have read and unconditionally accepted these GTU.
These terms set out the full scope of rights and obligations between the user and COMPANIONCARE. The current version of the GTU is always available on the website www.companioncare.fr and may be updated. It is recommended to check the GTU regularly to stay informed of any changes.

These General Terms of Use (GTU) govern the use of the COMPANIONCARE platform, accessible via the official website www.companioncare.fr and its mobile application. They define the terms of access, navigation, and use of the platform and associated services.
By using the COMPANIONCARE platform, you acknowledge having read and unconditionally accepted these GTU.
These conditions outline the entire set of rights and obligations between the user and the company COMPANIONCARE. The current version of the GTU is available at any time on www.companioncare.fr and may be updated. We recommend checking the GTU regularly to stay informed of any changes.
Article 1 – Definitions
Terms with a capital letter used in these GTU, whether singular or plural, have the following meanings:

COMPANIONCARE Platform: Refers to the web and mobile application developed by COMPANIONCARE, which enables users to access mental health and well-being services.

GTU (General Terms of Use): These terms of use governing access to and use of the COMPANIONCARE Platform and its services.

GTC (General Terms and Conditions of Sale): Refers to the terms and conditions governing the sale of services to End Users, including both the COMPANIONCARE GTC and Practitioner GTC. Users must accept the applicable GTC when purchasing services.

COMPANIONCARE GTC: The general sales terms for services provided directly by COMPANIONCARE, forming a contract between the End User and COMPANIONCARE.

Practitioner GTC: The general sales terms for services provided by Practitioners, forming a contract between the End User and each selected Practitioner.

Order: Any confirmed purchase of services provided by COMPANIONCARE or its Practitioners by the End User.

Personal Account: The private, secure account created by the User to access COMPANIONCARE services.

Content: All materials available on the COMPANIONCARE Platform, including text, images, videos, illustrations, and other media.

COMPANIONCARE: Refers to the company COMPANIONCARE, provider of both the Platform and its services.

User / You: Any individual over the age of 18 using the COMPANIONCARE Platform.

Practitioners: Mental health professionals listed on the Platform who provide services under their sole responsibility and in accordance with professional regulations. Each Practitioner is bound to COMPANIONCARE via separate Terms of Service.

Data Controller: As defined by applicable data protection laws, the entity responsible for processing personal data. For the Platform: Practitioners are responsible for data processed during video consultations, while COMPANIONCARE is responsible for all other user data.

Regulations: Refers to French Law No. 78-17 of January 6, 1978 (the “Data Protection Act”) and the EU Regulation 2016/679 of April 27, 2016 (GDPR).

Services: All services and content provided via the COMPANIONCARE Platform, including both COMPANIONCARE Services and Practitioner Services.

COMPANIONCARE Services: Services provided directly by COMPANIONCARE.

Practitioner Services: Services provided by registered healthcare professionals via the Platform.

Third-Party Funder: Any entity (insurance company, mutual insurer, broker, employer, public or private body) contracting with COMPANIONCARE to provide Users with access to the Platform and services.

Beneficiary: A User receiving COMPANIONCARE and Practitioner services funded by a Third-Party Funder.

Video Consultation: A remote consultation session via the COMPANIONCARE Platform between a User and a Practitioner.
Article 2 – The COMPANIONCARE Platform
COMPANIONCARE is a secure web and mobile platform accessible at www.companioncare.fr. It provides:

Booking appointments with mental health professionals

Attending remote consultations (video consultations)
-
Access to educational content and self-care programs
-
Secure messaging with Practitioners
The platform is designed to complement—not replace—traditional psychological care.
Article 3 – General Disclaimers
3.1 – COMPANIONCARE is not a medical device
The platform and its services are not considered a medical device under current regulations. It must not be used to:

Perform medical acts or teleconsultations

Deliver medical diagnoses, prescriptions, or treatments remotely

Monitor medical conditions remotely (telesurveillance)

Manage medical emergencies (in such cases, contact emergency services, e.g. 112)
3.2 – Practitioner guidance is not a substitute for medical advice
Information and advice provided via COMPANIONCARE is for support purposes only and does not replace consultation with a licensed healthcare provider. Users must not:

Delay or avoid seeing a doctor based on platform advice

Make medical decisions without consulting their physician or specialist

3.3 – User responsibility for their health
Users remain solely responsible for their health and medical choices. They are strongly encouraged to consult a healthcare professional when in doubt.
3.4 – A complementary solution
COMPANIONCARE is a supportive tool meant to complement medical care, not substitute it. Use of the platform must be part of an appropriate medical follow-up.
